Terms of Use
1. Purpose and acceptance
These Terms of Use ("Terms") govern access to and use of the Waystone mobile application and the joinwaystone.com website (the "Service"), published by Guillaume Cabrera, a sole trader. By creating an account or using the Service, you accept these Terms without reservation. If you do not accept them, you must stop using the Service.
2. Description of the Service
Waystone is a trip-planning application that lets you create itineraries, invite companions to collaborate, keep a travel journal and save memories. The Service relies on third-party sources (Wikipedia, OpenStreetMap) to enrich destination information; this information is provided for guidance only.
3. User account
Creating an account requires a valid email address, a password, and your first and last name. You must be at least 15 years old. You are responsible for keeping your credentials confidential and for any activity carried out from your account. The information you provide must be accurate and up to date.
4. Premium subscription
The Service offers a paid "Waystone Premium" subscription. This subscription is purchased and billed exclusively through Apple's App Store or the Google Play Store, under their terms. It renews automatically unless cancelled at least 24 hours before the renewal date, from your Apple or Google account settings. Refunds are handled by the relevant platform. As this is digital content supplied immediately, you acknowledge that the right of withdrawal may no longer apply once performance has begun with your express consent.
5. User content
You retain ownership of the content you create or import (trips, notes, photos, links). You grant the publisher a non-exclusive licence, limited to hosting and displaying this content for the sole purpose of providing the Service, in particular to the members with whom you share a trip. You warrant that you hold the necessary rights to the content you publish and are solely responsible for it.
6. Acceptable use
You agree not to:
- publish unlawful, defamatory, hateful content or content that infringes the rights of third parties;
- use the Service for fraudulent purposes or to compromise its security;
- attempt to access the accounts or data of other users without authorisation;
- extract or reuse the Service's data on a large scale by automated means.
7. Intellectual property
The trademark, logo, interface and code of the Service are the exclusive property of the publisher. These Terms grant you no ownership rights over these elements. Third-party content (Wikipedia, OpenStreetMap) remains subject to its respective licences.
8. Availability and changes
The publisher strives to keep the Service available but does not guarantee uninterrupted or error-free operation. The Service may change, be suspended or discontinued, in particular for maintenance or technical reasons.
9. Limitation of liability
The Service is provided "as is". To the extent permitted by law, the publisher cannot be held liable for indirect damages resulting from use of the Service, nor for the inaccuracy of destination information from third-party sources. Nothing in these Terms limits the publisher's liability in the event of gross negligence or wilful misconduct, nor the rights granted to consumers by law.
10. Suspension and termination
You may terminate your account at any time using the account-deletion feature in the App. The publisher may suspend or terminate access in the event of a breach of these Terms. Deleting the account results in the erasure of data under the conditions set out in the Privacy Policy.
11. Changes to the Terms
The publisher may amend these Terms. In the event of a substantial change, you will be informed through the Service. Continued use after the changes take effect constitutes acceptance.
12. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, you may use a consumer mediator free of charge. In accordance with Article 14 of Regulation (EU) No 524/2013, the European Commission provides an online dispute resolution platform available at ec.europa.eu/consumers/odr. Failing an amicable resolution, the French courts have jurisdiction.
